I can’t fathom how the CJ allowed this to happen when the applicants were asking for an order to get data. How can they get evidence when the EPA is the body that has the public duty to monitor such data?
I wonder if they made the point that Exxon is exceeding the safety limits and the EPA is enabling them to do so with the $50/ton CO2 fine, which enables Exxon to collect about 10x the fine in oil extracted over the safety limits.
